Land survey question

When land is sold and surveyed. Do they go by surveyed line or is the old fenceline grandfathered in when it comes to deciding the property line. From people I have talked to the old fenceline is grandfathered in.

Unless it is an extremely valuable piece (example a building is in dispute), the new survey is all that matters. It's a loser to fight it.

When my wife and I purchased our land 10 years ago the old fence lines played no part in establishing the property lines. It was surveyed and markers were put in to outline the property.

You need to check the deed's legal description to determine the actual land that is owned. If a CSM (Cetified Survey map) was created to deed the property then that will likely be your legal description and the boundry's will be shown by survey stakes. There are always exceptions but the fence dispute your refering to is called adverse possession. There are a number of criteria that must be proved to claim adverse possession. In any event it will become a legal action handled by the courts and whoverer can afford the best attorney usually wins. Its complicated.

It depends. How well maintained was the fenceline? Can you PROVE it was there for more than 20 years? How much money do people want to spend on lawsuits? The first two questions are key.
